GA TIX is a product of Outer Orbit Studios ("Company", "we", "our", "us"). By accessing or using the GA TIX platform (the "Platform"), you agree to these Terms of Use.

1. Acceptance of Terms

By using the Platform, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement.

2. Description of Services

GA TIX is a peer-to-peer listing platform that allows users to connect with other users for the purpose of buying and selling event tickets.

We are not a marketplace operator, broker, agent, or intermediary. We:

  • Do NOT own, sell, resell, or transfer tickets
  • Do NOT verify the authenticity, validity, or ownership of any tickets
  • Do NOT verify the identity, reliability, or trustworthiness of any users
  • Do NOT process payments, hold funds, or facilitate transactions
  • Do NOT guarantee that any transaction will be completed

Our role is strictly limited to providing a platform for users to post listings and communicate with one another.

3. Assumption of Risk

You acknowledge that:

  • Tickets may be invalid, duplicated, or misrepresented
  • Sellers may fail to deliver tickets
  • Buyers may fail to pay

You assume full responsibility for verifying all transaction details.

4. Payments

Payments are conducted through third-party services (e.g., Venmo, PayPal). We are NOT responsible for:

  • Payment disputes
  • Chargebacks
  • Fraudulent transactions

5. Limited Guarantee

Any “Money Back Guarantee” applies ONLY if:

  • The ticket was transferred through the original ticketing platform (e.g., Ticketmaster, AXS)

All other transactions are at your own risk.

6. User Conduct

You agree not to:

  • Commit fraud or misrepresentation
  • Upload false ticket information
  • Attempt to bypass platform safeguards

Important: GA TIX is not a party to any transaction and does not verify tickets or users. All transactions are conducted at your own risk.

Selling Tickets

When selling tickets on our platform, you agree to the following:

  • You are solely responsible for all aspects of your listing and transaction.
  • You represent that you are the lawful owner of the tickets and have the legal right to transfer them.
  • You will not list tickets that are stolen, fraudulent, duplicated, invalid, or obtained through unauthorized means.
  • You are responsible for ensuring that all listing information is accurate, complete, and not misleading, including event details, ticket type, and pricing.
  • You are solely responsible for setting the price of your tickets and complying with all applicable laws and regulations, including resale pricing restrictions.
  • You are solely responsible for delivering tickets to the buyer using a valid and functional transfer method.
  • You acknowledge that GA TIX does not verify tickets, listings, or users, and does not guarantee the completion of any transaction.
  • You understand that you assume all risks associated with selling tickets through the platform.

Buying Tickets

When buying tickets on our platform, you agree to the following:

  • You are solely responsible for evaluating listings and sellers before completing a transaction.
  • You are responsible for verifying all event and ticket details, including date, time, location, and ticket validity.
  • You are responsible for ensuring you have access to any required third-party ticketing platform to receive transferred tickets.
  • You acknowledge that GA TIX does not verify sellers or tickets and makes no guarantees regarding authenticity or delivery.
  • You assume all risks associated with purchasing tickets through the platform.
  • You are solely responsible for determining whether and how to complete payment to another user.
  • You understand that transactions are conducted directly between users and that GA TIX is not involved in the transaction.

Completing a Transaction

When engaging with another user to complete a ticket transaction, you agree to the following:

  • All transactions are conducted directly between users. GA TIX does not participate in, facilitate, or control any transaction.
  • You are solely responsible for communicating with the other party and determining whether to proceed with a transaction.
  • You understand that other users may receive certain profile information you have provided for the purpose of facilitating communication.
  • You acknowledge that GA TIX does not mediate disputes and is not responsible for resolving any issues between users.

7. User Content License

By submitting content (including listings and images), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content.

8. Account & Identity

You agree to provide accurate information. We may suspend accounts for suspected fraud or misuse.

9. Termination

We may suspend or terminate accounts at our sole discretion, without notice.

10. Disclaimer of Warranties

The Platform is provided "AS IS" without warranties of any kind. We do not guarantee:

  • Platform uptime or availability
  • Accuracy of listings
  • Security of transactions

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are NOT liable for indirect, incidental, or consequential damages
  • Total liability is limited to the greater of $100 or fees paid in the last 12 months

12. Indemnification

You agree to indemnify and hold harmless Outer Orbit Studios LLC from any claims arising from:

  • Your use of the Platform
  • Your transactions
  • Your violation of these Terms

13. Third-Party Services

We are not responsible for third-party services including ticket providers or payment platforms.

14. Force Majeure

We are not liable for failures caused by events beyond our control, including outages, cyberattacks, or third-party failures.

15. Arbitration & Class Action Waiver

All disputes shall be resolved through binding arbitration in California. You waive any right to participate in class action lawsuits.

16. Governing Law

These Terms are governed by the laws of the State of California.

17. Electronic Communications

You consent to receive communications electronically.

18. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
